BDSM and the Law: what every kinkster needs to know to better protect themselves, their businesses, and their play partners

Is that impact scene you are negotiating illegal and/or leave you open to legal liability? What happens if someone is injured in rope at your home? Who’s responsible for the medical costs if that edgeplay scene goes wrong? What legal recourse do you have if someone violates your consent (but the underlying activity is against local law)? Is your kink or sex positive business at risk of violating local or federal laws? What if someone posts something on FetLife about you that is untrue or posts a picture of you on Instagram without your consent? What rights do you have to keep your personal information (name, address, workplace) confidential?

The legal issues unique to our lifestyle are numerous and can seem complex. This class is an overview of legal issues unique to those of us engaged in an alt-sex or the BDSM lifestyle. While local laws (and enforcement) vary widely, we’ll highlight issues/activities where you may want to do some deeper risk assessment, document things a bit more carefully, and talk to an attorney before engaging further. We’ll also discuss proposed legislation and what you can do to make consensual kink less risky from a legal and liability standpoint.

About the Presenter:
Mx Bliss (she/they) is a gleeful sadist, sensation empath, consent enthusiast, rope switch, self suspender, and quinkster (queer kinkster). They identify as Daddy AF, on both sides of the slash. Bliss is having the time of their life discovering all the ways to connect with BDSM and rope and is eager to share the joy. She produces the Jiffy Kink events and is the Executive Director of the Congregation of Consensual Expression. She also co-hosts the Friction pop-up events. Formerly a business and social justice attorney, MxBliss frequently presents on negotiation, consent, kink and the law, and diversity/equity/inclusion. She’s making a living doing what she loves as a Dominance and executive coach and advising kink-positive businesses.
